Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of fluencysecurity.com and the content, documentation, forms, trials, and other material we make available through it (together, the “Site”). The Site is operated by Fluency Corp, Inc. (“Fluency,” “we,” “us,” or “our”), a company based in Rockville, Maryland.
By accessing or using the Site in any manner, you agree to these Terms. If you do not agree, please do not use the Site.
These Terms cover the website, not the products
Fluency SIEM and the other products and services we sell are provided under a separate written agreement between Fluency and the customer — typically a subscription agreement, order form, evaluation agreement, or reseller or MSSP agreement. Those agreements govern the products, including service levels, support, data handling, and commercial terms.
If anything in these Terms conflicts with a signed agreement covering your use of a Fluency product, that signed agreement controls for the subject matter it addresses. These Terms continue to apply to your use of the Site itself.
Who may use the Site
You must be at least 18 years old to use the Site. If you are using the Site on behalf of a company or other organization, you represent that you have authority to bind that organization to these Terms, and “you” refers to both you and that organization.
Permitted use
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable right to access and use the Site for your own internal business purposes and for evaluating whether Fluency is a fit for your organization. You may view, download, and print reasonable portions of Site content for that purpose, provided you do not remove any copyright, trademark, or other proprietary notices.
Things you agree not to do
You agree not to:
- Use the Site in violation of any applicable law or regulation, or to infringe anyone’s rights.
- Copy, republish, resell, frame, or redistribute Site content as your own, or use it to build or train a competing product or service offering.
- Scrape, harvest, or systematically extract content or contact details from the Site, or use automated means to access it in a way that degrades its availability for others.
- Probe, scan, or test the vulnerability of the Site or any related system, or attempt to breach authentication or access controls, except through the coordinated disclosure process described on our Security page.
- Interfere with or disrupt the Site, including by introducing malware or by overloading, flooding, or spamming it.
- Access the Site through any interface other than the one we provide, or misrepresent your identity or affiliation when submitting a form or requesting access.
- Reverse engineer, decompile, or disassemble any part of the Site, except to the extent that restriction is prohibited by applicable law.
Trials, demos, and evaluation access
We sometimes provide trial accounts, demo environments, documentation access, or other evaluation access through the Site. That access is provided for evaluation purposes only, may be limited in scope and duration, and may be modified, suspended, or withdrawn at any time. Evaluation access is provided as is, without any service level commitment, and is subject to any additional terms presented when access is granted.
If you are issued credentials or an access link, you are responsible for keeping them confidential and for activity conducted under them. Tell us promptly at contact@fluencysecurity.com if you believe credentials have been lost or misused.
Information you submit
When you request a demo, subscribe to updates, or otherwise contact us through the Site, you agree that the information you provide is accurate and that you have the right to provide it. Our handling of personal information is described in our Privacy Policy, which is incorporated into these Terms by reference.
Please do not send us confidential information, customer data, security logs, or other sensitive material through Site forms or email unless we have agreed in advance on how it will be handled. Sensitive values such as API tokens and credentials should never be submitted through a web form or a chat surface.
Feedback
If you send us ideas, suggestions, feature requests, or other feedback about Fluency, you grant us a perpetual, irrevocable, worldwide, royalty-free license to use and incorporate that feedback into our products and services without any obligation or compensation to you. We will not identify you as the source of feedback publicly without your permission.
Intellectual property
The Site and its content — including text, graphics, product screenshots, diagrams, video, documentation, software, and the selection and arrangement of all of it — are owned by Fluency or our licensors and are protected by copyright, trademark, and other laws. Except for the limited rights granted above, these Terms do not transfer any right, title, or interest in the Site or its content to you.
“Fluency,” “Fluency Security,” the Fluency logo, and our other marks are trademarks of Fluency Corp, Inc. You may not use them without our prior written permission, except to refer to Fluency accurately in a nominative way. Other names and logos appearing on the Site are the property of their respective owners, and their appearance does not imply any endorsement or affiliation unless stated.
Third-party links and services
The Site links to and embeds services we do not control — including documentation hosting, blog hosting, video platforms, chat and form providers, analytics, and social platforms. We provide these for convenience. We are not responsible for their content, availability, terms, or privacy practices, and linking to a third party is not an endorsement of it. Your use of a third-party service is governed by that party’s own terms.
No security or professional advice
Site content — including blog posts, reports, sample investigations, benchmarks, calculators, and comparison material — is provided for general informational purposes. It is not security, legal, compliance, or other professional advice, and it does not account for the specifics of your environment, obligations, or risk tolerance. Pricing, cost, and savings estimates produced by Site calculators are illustrative only and are not a quote or an offer. You are responsible for your own decisions and for evaluating what is appropriate for your organization.
Availability and changes
We may change, suspend, or discontinue any part of the Site at any time, including removing content or features, without notice and without liability to you. We may also update these Terms. When we do, we will revise the effective date above and, where the change is significant, provide a notice on the Site. Your continued use of the Site after a change takes effect means you accept the revised Terms.
Disclaimer of warranties
The Site and all content on it are provided “as is” and “as available,” without warranty of any kind, whether express, implied, or statutory. To the fullest extent permitted by law, Fluency disclaims all warranties, including any implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, and any warranty that the Site will be uninterrupted, timely, secure, error-free, or that content on it is accurate, complete, or current.
Limitation of liability
To the fullest extent permitted by law, Fluency and its officers, directors, employees, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, goodwill, or business opportunity, arising out of or related to your use of or inability to use the Site, whether based in contract, tort, strict liability, or any other theory, and whether or not we have been advised of the possibility of such damages.
To the fullest extent permitted by law, Fluency’s total aggregate liability arising out of or related to the Site and these Terms will not exceed one hundred U.S. dollars ($100).
Some jurisdictions do not allow the exclusion of certain warranties or the limitation of certain damages, so some of the above may not apply to you. Nothing in these Terms limits liability that cannot be limited under applicable law. This section does not limit or modify liability under a separate signed agreement covering a Fluency product; that agreement’s own liability terms govern it.
Indemnification
You agree to indemnify and hold harmless Fluency and its officers, directors, employees, and agents from any claims, damages, liabilities, and expenses (including reasonable attorneys’ fees) arising out of your use of the Site, your violation of these Terms, or your violation of any law or the rights of a third party.
Termination
We may suspend or terminate your access to the Site at any time, with or without notice, including if we believe you have violated these Terms. The sections of these Terms that by their nature should survive termination — including intellectual property, feedback, disclaimers, limitation of liability, indemnification, and governing law — will survive.
Governing law and venue
These Terms are governed by the laws of the State of Maryland, without regard to its conflict of laws rules. You and Fluency agree to the exclusive jurisdiction and venue of the state and federal courts located in Montgomery County, Maryland for any dispute arising out of or relating to these Terms or the Site, and each party waives any objection to that venue.
General
These Terms, together with our Privacy Policy, are the entire agreement between you and Fluency regarding the Site. If any provision is found unenforceable, it will be limited or severed to the minimum extent necessary and the rest will remain in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms without our written consent; we may assign them in connection with a merger, acquisition, or sale of assets.
